An Open Letter to Jeff Sessions

Dear Jeff Sessions:

I am writing to express my befuddlement over your various positions viz-a-viz the Constitution. Earlier this year, the Department of Justice announced it was restoring the ability of local law enforcement to use “civil forfeiture”- the seizure of money and property from citizens who have not been convicted of, or even charged with, a crime. Such actions are in direct contravention of the “Due Process” clause of the Fifth Amendment and should be considered extralegal by all reasonable standards.

You will agree, I am certain, that “no greater good can be done for the overall health and well-being of our Republic, than preserving and strengthening the impartial rule of law. Societies where the rule of law is treasured are societies that tend to flourish and succeed. Societies where the rule of law is subject to political whims and personal biases then to become societies afflicted by corruption, poverty, and human suffering.”

I am certain you will agree because those are your words. They were included in the statement you made last week in which you announced the rescinding of DACA. I might argue that you yourself, in ruling Obama’s Executive Order unlawful, have arrogated to yourself the powers of the legislature, but I will instead point out the inconsistency of your positions: In one instance, you cavalierly ignored rights granted by the Constitution while, in the other, you offer explicit concern about the constitutionality of an administrative ruling.

Which way is it? Are you subjecting the rule of law to a political whim or personal bias? It would illogical to maintain that you are presenting a consistent position.

As a matter of record, your Department is now re-trying Desiree Fairooz, the woman who laughed during your Senate confirmation hearing in January. She has previously been tried and found guilty, but the verdict was overturned. Do you have any justification for spending the taxpayers’ dollars on a new trial? Is this a matter of personal pique? If so, you are showing a lack of respect for both your office and the law itself.  

It is paramount that the Attorney General of the United States assure all citizens that our laws are applied fairly and equitably. It would be informative if your office would provide a current list of referrals of civil rights violations in which prosecution was declined. We the People need to know that you are not using the power of the office to pursue a personal agenda.
